7. Infringement Complaints

If a product or service is listed incorrectly (due to typographical or supplier error), Masala Gossip® reserves the right to refuse or cancel orders. If your card is charged, a refund will be issued promptly.

If a product does not match its description, your sole remedy is to return it in unused condition for a refund.

10. Risk of Loss & Returns

All purchases are shipped FOB origin—risk of loss passes to you upon delivery to the carrier. Title transfers back to us only upon receipt of returned merchandise.

Our total liability for any claim will not exceed the amount you paid for the product or service giving rise to the claim.

17. Disputes & Governing Law

All disputes relating to your use of Masala Gossip® Services or purchases through BeMasalaGossip.com shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA) in Fulton County, Georgia, USA.

You and Masala Gossip® agree that:

  • Arbitration will be conducted on an individual basis only (no class actions).

  • The Federal Arbitration Act and the laws of the State of Georgia govern these Terms.

  • Either party may seek injunctive relief in court for IP violations.

If arbitration is deemed unenforceable, disputes shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia.

18. Modification & Severability

Masala Gossip® reserves the right to modify its Services, policies, and these Terms at any time.
If any provision of these Terms is deemed invalid or unenforceable, that provision shall be severed without affecting the remainder.

19. Waiver

Failure by Masala Gossip® to enforce any right or provision shall not constitute a waiver of that right or provision. No waiver shall be deemed continuing or a waiver of any future breach.

20. Entire Agreement

These Terms, together with our Privacy Policy and any other posted policies, constitute the entire agreement between you and Masala Gossip® regarding the use of our Services and supersede all prior communications or agreements.
